                        No. G.S.R. 7/ C.A2/99/ S.74/ Amd /81.-In exercise of the powers conferred by section 74of the Indian Stamp Act, 1899 (Central Act No. 2 of 1899) and all other powers enabling him in this behalf, the Governor of Punjab is pleased to make the following rules further to amend the Indian Stamp Rules, 1925, in their application to the State of Punjab, namely:-

1.                  These rules may be called the Indian Stamp (Punjab First Amendment) Rules, 1981.

2.                  In the Indian Stamp Rules ,1925, rule 11, in sub-rule (3) , for clause (iv) and note there under, the following clause shall be substituted ,namely:-

 “(iv) In Chandigarh, the Superintendent or any  Assistant for the time being in-charge of the stamping work in the office of the Financial Commissioner, Punjab and  at the Divisional headquarters the Superintendent or any official in-charge of the Stamping work in the office of Commissioner.”

                        In the said notification ,under the heading “ Table of Registration Fee”, after the last existing provisions to Article 1 ,the following proviso shall be added, namely:-

“Provided further that no registration fee shall be chargeable on the sale deed of land measuring 323 Kanals and 9 Marlas, purchased by M/s Aumex India (P) Limited in villages, Aggwar Khuaza Baggu and Aggwar Gujjar, Near Jagraon, District Ludhiana for setting up a manufacturing unit for Infant Child Food and Nutritional Products.”

            No. 1/3/2000-AR-V/1550- To review the revenue laws of the State and suggest measures for smartening the revenue administration, the Governor of Punjab is pleased to constitute a Commission known as Punjab Revenue Commission.

FUNCTION AND SCOPE OF REFERENCE OF THE COMMISSION :

            The term of the Punjab Revenue Commission shall be for two year from the date of publication of the Notification.

            The terms of reference of the commission shall be as follows :-

(a)                To review the archaic revenue laws of the State as shown in Annexure-I as

Per priority indicated therein and make recommendations for amending/repealing the same and suggest other measures for smartening the revenue administration.

(b)               In addition to above, the Commission would also examine the following aspect:-

 

(i)                  to ascertain if any provision of the existing law as detailed in the  Acts mentioned  at Annexure-I is inconsistent with the Constitution of India and to suggest the necessary alteration and modification.”

(ii)                The ambiguities in the existing laws brought to light by conflicting decision of the Supreme Court and the High Court or otherwise; and also to suggest the omission of unnecessary and obsolete laws;

(iii)               To make suggestions for simplification of procedure in the revenue courts;

(iv)              To suggest ways and means for improving administration of Justice in the Department of Revenue.

           

(c)                The Commission will further look into the aspects of the :-

 

(i)                  number of levels of appeals as prescribed in the various Acts/Laws;

(ii)                the time limit to be observed for disposal of the appeals under various laws;

 

(d)               The commission shall have the access to the data being maintained by the Department of Revenue and Rehabilitation or Director, Land Records, Punjab.

(e)                The Commission may associate any of the functionaries of the Department of Revenue and Rehabilitation including the office of the Deputy Commissioner’s as well as their Subordinates.

(f)                 The Commission may visit the other State in order to see the implementation actually being made for the laws recommended for the formulation by it.

(g)                The Acts administered by the Revenue and Rehabilitation which are being reviewed by the Punjab State Law Commission shall be taken out to the preview of the Punjab State Law Commission. However, the material available with the Punjab State Law Commission may he used for harmonious and comprehensive examination by the Punjab Revenue Commission.

 

3.         HEADQUARTERS :

 

            The Commission would occupy suitable office accommodation as per usual norms of the State Government at a place easily accessible to the Department of Revenue and Rehabilitation and shall have its headquarters at Chandigarh or S.A.S. Nagar (Mohali).

 

4.         SUBMISSION OF REPORT :

 

            The Commission shall submit its report to the Government within two years from the date of its Notification.

                        No. S.O. 7 /CA. 16/1908/Ss.78and 79/Amd./2007.- In exercise of the powers conferred by section 78 and 79 of the Registration Act, 1908 (Central Act N. 16 of 1908, and all other powers enabling him in this behalf, the Governor of Punjab is pleased to make the following amendment in the Government of Punjab ,Department of Revenue and Rehabilitation (Registration), Notification No. S.O. 25/C.A.16/1908 Ss 78 and 79/80/6056,dated the 15th April, 1980, namely:-

 

                                                            AMENDMENT

                        In the said notification, under the heading “Table of Registration Fee” ,after the last existing proviso to Article-I ,the following proviso shall be added ,namely:-

 

                        “Provided further that no registration fee shall be chargeable on the sale deeds of the land, the details of which have been given in the Schedule give below, which is to be purchased by M/S A.B. Grain Spirits Pvt. Ltd., Dasuya, District Hoshiarpur, at Village Kiri Afghana, District Gurdaspur, for setting up its units.”

AN

ORDINANCE

 

Further to amend the Indian Stamp Act, 1899, in its application to the State of Punjab .

           

            Promulgated by the Governor of Punjab in the Fifty-eighth Year of the Republic of India.

            Whereas the Legislative Assembly of the State of Punjab is not in session and the Governor is satisfied that circumstances exist, which render it necessary for him to take immediate action;

            Now, therefore, in exercise of the powers conferred by clause (1) of article 213 of the Constitution of India, the Governor of Punjab is pleased  to promulgated the following Ordinance, namely:-

 

            1.         (1)        This Ordinance may be called the Indian Stamp          short title and

                                    Punjab Amendment)Ordinance, 2007                         commencement

 

              (2)      It shall come into force at once

         “Provided further that no registration fee shall be chargeable  on transactions pertaining to sale/transfer of built up space of the units or land inside the project area by M/s Quark or any of its Affiliates, Subsidiaries and Associates to any third party. The remission shall remain operative for a period of seven years or till the subsistence of the agreement dated 3rd November,2003, executed by M/s Quark, whichever is earlier, in respect of Phase-I of the project comprising Plot No.A-40-A measuring 46.34 acres at Industrial Focal Point, Phase-VIII extension, Mohali and Plot No.A-45 measuring 5 acres at Industrial Focal Point, Phase VIII- B, Mohali.

            1.(1)     These rules may be called the Punjab Land Reforms (Second Amendment) Rules, 2008.

            (2)        They shall come into force on and with effect form the date of their publication in the Official Gazette.

            (3)        In the Punjab Land Reforms Rules, 1973 for the existing rule 3, the following rule shall be substituted, namely:-

                        No. G.S.R.10/P.A.10/1973/S.26/Amd.(8)/2008.- In exercise of the powers conferred by sub-section (1) of section 26 of the Punjab Land Reforms Act, 1972 (Punjab Act No. 10 of 1973), and all other powers enabling him in this behalf, the Governor of Punjab is pleased to make the following rules further to amend the Punjab Land Reforms Rules, 1973 namely:-

RULES

            1.(1)     These rules may be called the Punjab Land Reforms (First Amendment) Rules, 2008.

            (2)        They shall come into force on and with effect form the date of their publication in the Official Gazette.

            2.         In the Punjab Land Reforms Rules, 1973 in rule 5, in sub-rule(2), the following proviso shall be added, namely:-

“Provided that the period of four months and fifteen days shall be deemed to have been extended for a period of one year to file declaration referred to in sub-rule (1), if the person is a developer/promoter of a project and requires the land for the purposes other than agricultural or subservient to agriculture or for pasture and has applied for change of land use to the concerned department of the State Government within a period of four months and fifteen days.

Explanation.- For the purpose of this sub-rule, a developer/promoter shall mean a person who requires land to develop a project other than a project of agricultural purpose or purpose subservient thereto or a pasture, to be approved by the concerned department of the Government of Punjab:.

Subject:            Allotment of funds under head “2245-Relief on Account of Natural Calamities” for the year 2007-08.

Reference:        Your letter No. FRC/366, dated 25-2-2008.

                        An amount of Rs. 15,00,000/-was allotted to your district vide this department letter No. 1/12/2007-A.5/6574, dated 22-8-2007 for meeting the exigencies of floods which was surrendered vide your office letter No. FRC/2976, dated 29-10-2007. Therefore out of this surrendered amount, sanction amounting to Rs. 1,00,000/- (Rs. One Lac only) is hereby accorded to the next kin of Smt. Meena w/o Sh. Ramu and Sh. Happy s/o Sh. Ramu r/o  Village Rampur whose death was caused by heavy rains/floods on 26/27-7-2006 in your district.

2.                     The relief may be disbursed strictly in accordance with relevant rules and instruction of the Govt. issued from time to time.

3.                     The withdrawals of funds from the Treasury shall be made strictly in accordance with the requirement for immediate disbursements. Funds should not be drawn in excess of the immediate requirement in any circumstances.

4.                     Amount release in excess of requirement, if any, should be immediately surrendered to this Department, indicating reasons for the same.

5.                     The expenditure will be met from the Head”2245-Relief on Account of Natural Calamities-02-Flood/Cyclones etc.-111-Ex-gratia payment to bereaved families” for the year 2007-08 under the Grant No. 22 ‘Revenue and Rehabilitation’. The expenditure met from head “2245-Relief on Account of Natural Calamities” will be recouped from Calamity Relief Fund later on.

6.                     The Utilization Certificate of actual expenditure, along with balance amount, if any, may be sent through a Bank Draft in favor of “Punjab Calamity Relief Fund” to the Assistant Controller (Finance & Accounts), Revenue Department, 2nd Floor, Punjab Civil Secretariat, Chandigarh, within one month from the date of receipt of this sanction.

                        This sanction is issued with the concurrence of Finance Department already conveyed vide their I.D.No. 5/15/2007-2F.E.6/2493, dated 22-8-2007.

                        An amount of Rs. 50,00,000/-was allotted to your district vide this department letter No. 1/12/2007-A.5/6574, dated 22-8-2007 for meeting the exigencies of floods which was surrendered vide your office letter No. 2408/Flood, dated 19-10-2007. Therefore out of this surrendered amount, sanction amounting to Rs. 20,000/- (Rs. Twenty Thousand only) is hereby accorded to the legal heirs of Sh. Gurcharan Singh s/o Sh. Moola Singh for the disbursement of undisbursed relief pertaining to the year 2004-05 on account of loss to crops caused by Floods/hailstorm in your district.

2.                     The relief may be disbursed strictly in accordance with relevant rules and instruction of the Govt. issued from time to time.

3.                     The withdrawals of funds from the Treasury shall be made strictly in accordance with the requirement for immediate disbursements. Funds should not be drawn in excess of the immediate requirement in any circumstances.
