1. Short title:
These rules may be called
the Punjab Bhudan Yagna Rules, 1959.
In these rules unless there is anything repugnant in the subject
or context,-
(a)
‘Act’ means the Punjab Bhudan Yagna Act,
1955.
(b)
‘Form’
means a form appended to these Rules.
Sections 2(f).- The area of land for the purposes of clause (f) of
section 2 of the Act shall be five standard acres.
Explanation.- For the purposes of this rules, the expression “Standard acre”
shall have the same meaning as is assigned to it in sub-section (5) of section
2 of the Punjab Security of Land Tenures Act, 1953, and clause (i) of section 2
of the Pepsu Tenancy and Agricultural lands Act, 1955, in respect of the land
held by the landless person in the respective territories to which the
above-mentioned Act extend and the conversion of the ordinary acres into
standard acres shall be effected in the manner laid down in rule 2 of the
Punjab Security of Land Tenures Rules, 1953, and rule 5 of the Pepsu Tenancy
and Agricultural Lands Rules 1958 as the case may be.
Section 17(1).- A
declaration making an offer of gift of land under sub-section (1) of section 17
of the Act shall be made in form A.
5. Form
of notice:
Section 17(3).- The notice required to be issued under sub-section
(3) of section 17 of the Act shall be in Form B.
Section 37(1).-
Orders passed under sub-section (7) of section 17 of the Act shall be drawn up
in form C.
7. Transmission of order
to Registering Officer, Punjab Bhudan Yagna, Board and the donor
Section 37.- (1) Immediately after
passing an order under sub-section (7) of section 17 of the Act, the Revenue
Officer shall forward the order in original in Form C ton the Registering Officer
within the local limits of whose jurisdiction the whole or any part of the
donated land is situate, who shall thereupon proceed to register the same in
accordance with law.
(2) After the order has been forwarded to the registering officer under sub-rule (1) the Revenue Officer shall send a certified copy thereof to the Board and deliver or cause to be delivered another copy to the donor.
8. Other particulars
in respect of land donated prior to the commencement of the Act.:
The Board shall while
preparing a list under sub-section (1) of section 21 (A) of the Act, also show
the following particulars namely,-
(1) Land Revenue, rates and cesses and rent,
if any payable;
(2) Section
21(1)(f).-
Full particulars of encumbrances including maintenance charges and attachments
by a Civil Court or a Revenue Officer; and
(3) Arrears of land revenue rates and cesses
and rent if any payable.

Note. –Give details of special power by virtue of which the declarant is
authorised to make the gift, e.g., as a father or manager in a Hindu Joint
Family,
5. The declarant(s) hereby offers/offer to transfer by way of the land(s) specified in paragraph 4 above to the, Punjab Bhudan Yagna Board and declares/declare that he/she/they has/have a lawful title to the aforesaid land(s) free from encumbrances of all kinds, including those mentioned in column (7) above and that no arrears of revenue or rent are due in respect thereof save as specified in column 8. The declarant(s) further declares/declare that he/she/they possesses/possess transferable interest in the aforesaid land(s) and that he/she/they is/are competent under the law to which he/she/they are/is subject to make a gift thereof.

to the Punjab Bhudan Yagna Board for donation of land specified in the Schedule
below;
And
Whereas the said Board has considered the gift acceptable and accordingly
forwarded the application to me for further action;
And
whereas upon making a summary enquiry as required by sub-section (3) of section
17 of the Punjab Bhudan Yagna Act, 1955 (45 of 1956), I am satisfied that the
donor(s) has/have valid title to the said land and is/are competent to make the
gift;
And Whereas it appears to me that you are interested in
the said land;
Now,
Therefore, under sub-section (3) of section 17 of the said Act, you are hereby
given this notice to appear before me on-----------------19------------, at
----------a.m. in person or by a duly authorised pleader or agent and show
cause why the gift should not be accepted.
Notice
is hereby given that if no objection showing cause why the gift should not be
accepted is filed on or before the date specified above shall proceed to accept
the gift on behalf of the Board.

considering the gift acceptable a notice, as required by sub-section (3) of
section 17 of the Punjab Bhudan Yagna Act, 1955 (45 of 1956), was issued after
making an enquiry as required thereunder.
And
whereas no objection was filed/and whereas all objection filed to the
acceptance of the said gift under sub-section (5) of section 17 of the said act
have been duly enquired into and rejected.
Now, Therefore, it is ordered and declared that the gift of the land/lands described in the Schedule appended hereto is hereby accepted on behalf of the Board.
