Terms of service

Applicant must have interest in the land in question as he has to furnish an affidavit that there is no loan against this land.

Procedure

The applicant would furnish an affidavit that he has not availed of any loan against this land. In this regard, a report is  also got  from the halqa Patwari . After this the Registry Clerk verifies from the record with the help of index. He will issue NEC after getting approval from the sub Registrar/Joint Sub Registrar.

According to Sec.110 of the Punjab Land Revenue Act, 1887, got partitioned land can be with in regard to

(i)  ownership

Terms

Any Joint owner of land, or any Joint tenant whose right of occupancy subsists , may apply to a Revenue Officer, provided

(i) At the date of application, the share is recorded under chapter IV as belonging to him or

(ii) His right to the share has been established by a decree which still subsists or

(iii) A written acknowledgement of that right has been executed by all persons interested in the admission or denial thereof.

Procedure

(i) The applicant personally or through his Counsel can submit an application to Tehsildar -cum-AC Ist grade in accordance with Sec.111 of the Punjab Land Revenue Act, 1887

(ii) Tehsildar-cum-A.C.Ist grade summons Respondents Under Section 20 of the above Act    who submits reply.

(iii) In brief, after going through all the section i.e..111 to 122 of the above Act partition of Land is finalised and shareholders get their possessions separately.

Khasra Girdawari can be corrected only for the period relating to the current  Jamabandi which would be incorporated in the next Jamabandi.

Terms of service

Any person claiming his cultivating possession can apply.

Procedure

The applicant personally or through his counsel submits an application to the CRO-cum- AC II grade for the correction of  Khasra Girdawari . Respondents are summoned who submit reply. After this both the counsels argue. First of all applicant submit documentary evidence in support of his possession over the land. Therefore, respondent submit documentary evidence. Spot of  the disputed Land is inspected in presence of both the parties, Namberdar, respectables etc. On the basis of above facts ,the possession is decided. Patwari is informed of the decision, which is incorporated in the record.

Method of verification

(i)  In case of death , resignation or dismissal of a Nambardar  the Halqa Patwari submits the report for the same.

(ii) CRO-AC IInd grade sends this file to the Collector through AC Ist Grade (SDM) to get approval to start the file for the appointment of the Nambardar

(iii) After getting the approval from the Collector AC IInd Grade issues order for "MUSHTRI MUNADI" that any interested person can submit an application to the AC IInd grade by a fixed date for the post of a Nambardar. Mushtri Munadi is done by the Chawkidar through halqa Patwari in presence of village respectables. One copy of the notice is put on a public place specifying the date by which applications are to be submitted. By that date applications are received.

(iv) statements of applicant- candidates are recorded. Candidates submits documentary proofs in support of their candidature.

(v) After this character verification is got from the  

Local police and Naksha Numberdar from the halqa Patwari.

After going through the statements of the candidates and other facts , name of one most eligible candidate is recommended for the post of the Namberdar. These recommendations are sent to the A.C.Ist grade (SDM), who sends his recommendations to the Distt. Collector. The Distt. Collector appoints one candidate as a Namberdar after hearing the participating candidates.

"Sanad Nambardari" is issued after the expiry of 30 days from the date of decision of the Collector. This is incorporated in revenue record at Tehsil level.

SURBRAH NAMBARDAR

              If a Nambardar is unable to discharge his duties temporarily , he can get appointed any person as his surbrah.

              In this regard he submits an application to the Tehsildar /Naib Tehsildar Cum CRO -AC IInd grade who sends his recommendations  to the SDM-AC Ist grade. AC Ist grade (SDM) sends his recommendations to the Distt. Collector who appoints surbrah-Namberdar.

HARIJAN NAMBARDAR

where the population of Harijans or members of Scheduled castes including Christians is 100 or more in an estate, there shall be appointed a harijan Nambardar.

A harijan Nambardar need not to possess land. He does not  collect land revenue. He cannot appoint his Surbrah Namberdar.

Terms of the  service

 

Method of availing the service

Any document has to pass through the following four stages for its registration.

(1) Purchase of the stamp paper.

(2) Execution

(3) Presentation of document for registration

(4) Registration of the document and its maintenance in the record room.

 

1)        Purchase of stamp paper.

           

            Stamp papers are purchased in the name of "seller" or holder of power of attorney of the seller. Stamp-vendor must sign on the back. If the stamp paper is purchased from the treasury, then some official of T.O. must sign on its back.

 

2)        Execution.

 

            Seller-Purchaser or mortgagor-mortgagee, Namberdar and witness put their signatures on it after it has been written.

 

3)        Presentation or document for registration:

           

            When the document is presented before the  registering officer he, after verifying the document that it is in order, gets signature of the seller-purchaser or mortgagor- mortgagee etc. Namberdar and witness on the back of it in his presence. He puts wasika Nos. -Bahi nos- Jild nos. and date on the document and registers it.

 

4)       Registration of Document and its maintenance  in the Record Room

 

After registration of a document, its one copy is maintained in the office as record.

 

            Registration of a will:

 

(a)      Any person can appear before the registering officer to get his will registered. The registering officer will satisfy himself that the testator is not a minor an idiot or a lunatic. He is not being exploited due to his illness or old age.

 

(b)      Under Sec. 40-41 of the Registration Act 1908, the will can be registered even after death. The registering officer will satisfy himself that

              (i)      The will is presented by a person who is entitled to do so.

              (ii)      The testator is dead.

              (iii)     The will was executed during the life time of the testator.

              (iv)    These facts are confirmed by publication in newspaper.

 

Refusal to register the deed

 

In case the person executing the deed gives his denial or a person executing the deed is a minor, an idiot or a lunatic then the registering officer can refuse to register the deed. He will record the reasons for refusal in Book No.2

The document in respect of which the stamp duty is to be refunded must not have been presented before the sub registrar.

(i) Unwritten stamp paper can be refunded within 6 months

     but the unwritten stamp paper can be used at any time.

      it must be got registered within 4 months.

Procedure

The applicant submits an application in the prescribed proforma to the SDM for refund of stamp paper along with stamp paper.

SDM gets report from the Tehsildar to verify certain facts.

If the stamp papers are genuine and within the limitation period , the SDM passes an order for refunding the same after deducting 10% of it.

Terms of Service

Applicant must be a resident of the village having ability to perform his duties with good health and character.

Procedure

In case of death, resignation or dismissal (by a competent Court) of a Chaukidar, the halqa Patwari submits report to the CRO Tehsildar/ Naib Tehsildar and makes an entry in the Roznamcha.

The CRO sends this report to the Distt. Collector through AC Ist Grade(SDMo get approval to start the file for the appointment of a new chaukidar.

After getting approval from the Distt/. Collector AC IInd grade issues order for "Mushtri Munadi" that any interested person can submit a application to the AC IInd Grade by a fixed date for the post of chaukidar.

Applications are received upto the date fixed in Mustri Munadi.

After this, statements of candidates are recorded. Police verification regarding character etc. is done.

Keeping in view statements recorded, educational qualification, age, ability to do work and character one candidate is recommended for the post of chaukidar. This file is sent to SDM-AC Ist grade. SDM-AC Ist grade after hearing all the candidates, finally appoints one candidate as Chaukidar.

Terms of service

Marriage solemnized already are registered under the Hindu Marriage Act 1955.

Either bride or bridegroom must be resident of the Tehsil in which the marriage is to be registered.

At the time of marriage the bridegroom must have completed the age of 21 years and bride the age of 18 years.

Both must be Hindus.

Procedure

At the time of registration of marriage the applicant submits an application in prescribed form stamped with Court fees Rs. 1.25. Marriage Registration fees is deposited in 32-A form under head No.0070 in the bank. This marriage is registered under the Hindu Marriage Act 1955 on the identification of village Namberdar.

Following points must be kept in mind while registering marriage.

(i)  Bride and bridegroom must not have

      blood-relation.

(ii)  Identification by village Namberdar.

(iii) Bride and bridegroom must be present

       personally.

(iv) If any of the two is not present personally, a notice is sent to him regarding registration of marriage if he agrees or not. After receiving the repay in positive the marriage is registered. This notice must be attested by the Notary Public of that country.

The notice of proclamation carries the description of property to be sold, location, boundaries, time , place of auction, terms and conditions of the sale.

"Mushtri Munadi" will also be done in that area. Patwari halqa will make an entry in his Roznamcha.

The highest bidder at public auction shall be required to pay 1/4th share on the spot.

Within 15 days from the approval by the sales Commission remaining amount is deposited and conveyance deed is issued.

On the basis of possession

On the basis of possession, the Govt. announces policy from time to time. Applications are invited from the unauthorised occupants by a fixed date.

A date is fixed as a cut off date from where the unauthorised possession is to be counted. This possession should be continuous.

The price of the land is fixed by a committee appointed by the Govt.

Limits of the area to be allotted is fixed categorywise by the Govt. in the policy.

Terms of Services

Owner of Land or any person interested   (according to Section 101 The Punjab Land  Revenue Act 1887)

Service requirement

1.Any Person intending to have demarcation of land submits an application to the Revenue Officer duly stamped with court fees Rs.1.25 in duplicate alongwith copy of latest Jamabandi.

2. The application  is entered in the register . One copy of it sent to the concerned halqa Kanungo. The halqa Kanungo would ensure that this demarcation is done within one month.

(3) The revenue officer would call the applicant by a date fixed so that he may bring to the notice of revenue officer whether demarcation of land is done or not. The revenue officer will ensure that the applicant is not called more than twice.

(i)  A person who is not owner can not have demarcation of land.                                                Committed Under Section 101 of the Punjab have to prove, how he is interested in the land.

The Applicant must have documentary evidence in support of his right.

Service requirement

1. Whenever  any person acquires a  right  by a registered deed (sale , share, exchange, Mortgage, Transfer, will etc.), the halqa  Patwari enters the mutation from registered memorandum. Mutations are attested by the CRO according to his tour programme. Halqa Patwari informs the concerned persons about the tour programme by telling them venue-date and time.

 

2. Some times rights are transferred by documents which are not registered. For such a transfer all the necessary documents are to be submitted to the CRO.

 

3. As regards to Mutations of inheritance, the halqa patwari enters them after checking the chaukidar's register every month. But the right holder can approach directly to the Patwari for entering the mutation.

4. If any new fact or mistake comes to notice after the attestation of mutation but before the preparation of new Jamabandi, then the attesting official or his successor can review it after getting approval from the Collector. An appeal lies to the AC Ist grade- SDM within 30 days from its decision.

Mistake not to be done

1. Mutations of sale, mortgage with possession, and exchange are not  attested until the physical possession are interchanged.

2. In a Will, the left out heirs must be heard,

3 Halqa Kanungo must check the old entry of Jamabandi physically from record.

4.Shazra Nasab must be got attested from the Namberdar of the revenue estate.
